Bharatiya Sakshya Adhiniyam, 2023
Expert Witness & Deposition Services
Courtroom expert testimony and affidavit services under the Bharatiya Sakshya Adhiniyam, 2023 — strictly governed by a mandatory Stage 1 viability audit.
Overview
Expert witness testimony in medical and healthcare matters requires a forensic analyst who can translate complex clinical facts into clear, court-admissible evidence. Dr. Himanshu Vats provides independent expert witness services governed by the Bharatiya Sakshya Adhiniyam, 2023 (BSA 2023), the successor legislation to the Indian Evidence Act, 1872.
Under Section 39 of the BSA 2023, expert opinion is admissible on matters of science, art, foreign law, or trade custom. Medical and forensic document analysis falls squarely within this provision. Dr. Vats's opinions are grounded in clinical evidence, public health systems knowledge, and a formal legal education — ensuring they withstand rigorous cross-examination.
Mandatory Stage 1 Viability Audit
No retainership proposal for expert witness services is issued without a prior Stage 1 viability audit. This is a non-negotiable procedural safeguard.
01
Case Submission
Submit the case file via the Case Intake form with all mandatory disclosures. A Tier 1 or Tier 3 engagement is typically required as the Stage 1 audit.
02
Viability Assessment
Dr. Vats conducts a thorough forensic review to assess whether the case presents a viable, defensible expert opinion. Not all cases will proceed to expert witness engagement.
03
Retainership Proposal
If the viability audit supports an expert opinion, a formal retainership proposal is issued with scope, fee, and timeline. This is a separate engagement from the audit fee.
04
Affidavit & Testimony
Upon retainership, a formal expert opinion affidavit is prepared in accordance with BSA 2023 requirements. Deposition and cross-examination support are provided as agreed.
