Terms and Conditions of Service & Binding Legal Agreement

CRITICAL NOTICE: By accessing medicolegalexpert.in, remitting any consultation fee, or uploading clinical documents to our secure vault, you (the "Client" or "Instructing Counsel") acknowledge that you have read, understood, and unconditionally agreed to be bound by these strict Terms and Conditions. If you do not agree to these terms in their entirety, you must exit this platform immediately.

1. Absolute Disclaimer of Clinical and Legal Representation

Dr. Himanshu Vats (Delhi Registration: BHSD/4983) operates strictly as an independent forensic document analyst and technical consultant.

  • No Legal Privilege: Dr. Vats is NOT an enrolled practicing Advocate under the Advocates Act, 1961. We do not provide legal representation, draft court pleadings, or solicit legal briefs.
  • No Doctor-Patient Relationship: Services provided are retrospective forensic audits of clinical paperwork. We do not provide medical diagnosis, second opinions for active treatment, or acute care. No doctor-patient relationship is established, implied, or entertained.

2. Scientific Independence & The "Anti-Influence" Clause

Payment of a consultation fee secures Dr. Vats' technical time and expertise; it does not guarantee a favorable finding.

  • Our forensic audits are brutally objective and governed solely by the scientific record and the Jacob Mathew standard of care.
  • If the clinical evidence reveals that your claim lacks merit, or that your defense is clinically indefensible, our Medico-Legal Assessment Report will state so unequivocally. We will not manufacture, alter, or embellish findings to suit a legal narrative.

3. Client's Burden of Authenticity & Document Integrity

The Client is 100% responsible for the authenticity, completeness, and legibility of all Bed-Head Tickets (BHTs), Medico-Legal Case (MLC) papers, and SOPs submitted for audit.

  • medicolegalexpert.in operates on the presumption that the documents uploaded by the Client are exact, untampered replicas of the hospital record.
  • We accept zero liability for any gaps, errors, or subsequent judicial dismissals resulting from the Client's failure to provide the complete, unredacted clinical file.

4. Strict Non-Refund & Commercial Finality Policy

Our services involve the immediate deployment of highly specialized intellectual property and technical time. Fees are structured across three audience verticals — Patients & Injury Victims (₹5,000–₹15,000), Litigators & Independent Counsel (₹10,000–₹25,000), and Hospitals & Clinical Establishments (₹50,000 and above).

  • All fees across all verticals and levels are payable 100% in advance.
  • Zero-Refund Guarantee: Once a payment is executed and a case file is successfully ingested into our vault, the engagement is initiated. No refunds, chargebacks, or partial credits will be issued under any circumstances, including but not limited to the Client deciding to abandon litigation, settling the dispute out of court, or disagreeing with our objective forensic findings.

5. Limitation of Liability (Financial Cap)

To the maximum extent permitted by Indian Law, neither Dr. Himanshu Vats nor medicolegalexpert.in shall be held liable for any direct, indirect, punitive, incidental, or consequential damages (including lost compensation claims, lost hospital revenue, or legal penalties) arising from the use of our Medico-Legal Assessment Reports.

  • Maximum Liability Cap: In the event of any proven deficiency of service, our total cumulative liability shall be strictly capped at, and shall not exceed, the exact consultation fee paid by the Client for that specific matter.

6. Indemnification by the Client

The Client agrees to fully indemnify, defend, and hold harmless Dr. Himanshu Vats from any claims, legal notices, Bar Council complaints, Medical Council summons, or financial losses arising directly or indirectly from:

  • The Client's misuse of our reports or misrepresentation of our services in court.
  • Submission of forged or tampered medical documents.

7. Expert Witness Limitations & Subpoenas

An audit report from medicolegalexpert.in is a technical advisory. It does not bind Dr. Vats to appear as an Expert Witness.

  • Any requirement for courtroom testimony, cross-examination presence, or sworn affidavits under the Bharatiya Sakshya Adhiniyam, 2023 mandates a separate Stage-1 Viability Assessment and a distinct commercial Retainer Agreement.

8. Governing Law & Exclusive Jurisdiction

This Agreement shall be governed exclusively by the laws of the Republic of India.

  • Any dispute, claim, or controversy arising out of this engagement shall be subject to the exclusive and mandatory jurisdiction of the competent courts located in New Delhi, India.
